900,000 UK boaters set to be hit by post-Brexit travel rules is RYA survey finding

Two passports and a map showing the UKAlmost 900,000 UK boaters are due to be hit by post-Brexit travel rules on how long they can stay in Europe after the Brexit transition period ends on 31 December 2020, a new survey by the RYA has found.

With the end of the free movement of people, UK citizens, including boaters, will be restricted to spending no more than 90 days in a rolling 180-day period in the Schengen Area (the Schengen rule) before they have to obtain a visa for each Schengen country they plan to visit.

The RYA’s survey shows that of the estimated 1.2 million UK boaters who currently boat in the Schengen Area, 74% spend more than 90 days in 180 in the Area either boating or on other leisure or travel activities. This equates to almost 900,000 UK boaters whose plans will be disrupted by the change in travel rules on 31 December. Responding to specific questions in the survey, 53% of UK boaters boating abroad said they will be ‘greatly affected’ by the limitations of the Schengen rule. The Maritime Coastguard Agency (MCA) have released information about their new proposed regulation for Bilge Water Alarms.

Consultation is due to begin on draft legislation that intends to reduce the risk of an accident arising as a result of water coming into a vessel without the crew knowing it is happening.

The new regulations would mean that all vessels greater than 24 metres in length but less than 500 gross tonnage would have to be fitted with bilge alarms.

Transport Malta has reiterated the need for compliance with the Directive 2014/90/EU on Marine Equipment (MED). The Directive requires recognised organisations to inform the Directorate in cases where it is suspected that MED equipment placed onboard a Maltese ship is not compliant with the applicable requirements.

Market surveillance also includes activities carried out in the course of the Directorate’s recognised organisations auditing and oversight programme with respect to compliance with the MED of equipment placed onboard.

The company owners of two UK-registered fishing vessels which went to sea without the correct certification have been found guilty in a MCA prosecution and fined a total of £4,000.

Philomena Trawlers Ltd and D&G Seafoods Ltd were represented by defence lawyer Paul Rogers at the hearing at Southampton Magistrates Court on Friday, August 28.

Both companies pleaded guilty to charges of offences Contrary to Regulations 5(1)(b) and 5(4) of the Fishing Vessels (Codes of Practice) Regulations 2017. Philomena Trawlers Ltd were fined £1,000 and D&G Seafoods Ltd were fined £3,000 and ordered to pay costs of £8,380. MCA detains six fishing vessels in safety effort due to breaches of legislation

The Maritime and Coastguard Agency has detained a further UK flagged fishing vessel following its failure to get its mandatory intermediate survey done in time. Owners of the scallop dredger, Zara Annabel, have been served with the notice to ensure the vessel makes for the nearest suitable port and to notify the crew that its UK Fishing Vessel Certificate is no longer valid. It brings to a total of six the number of UK flagged fishing vessels detained by the MCA over the past two weeks after being found to be non-compliant with multiple areas of legislation under the Merchant Shipping Act.

The Australian Maritime Safety Authority (AMSA) is launching a focused container ship inspection campaign targeting cargo securing arrangements on container ships visiting Australian ports. This inspection campaign is being initiated in response to several serious incidents involving shipping containers lost overboard recently.

Incidents like the losses of 81 containers off Newcastle by the YM Efficiency in 2018, 50 containers off Wollongong by the APL England in May and three containers from the Navios Unite off Cape Leeuwin in June have caused significant environmental damage to Australia’s iconic marine and coastal environment have made this container ships inspection campaign necessary. MAIB have published their report on the container ship Ever Smart. On 30 October 2017, the UK registered container ship Ever Smart suffered a container stow collapse while on passage between Taipei, Taiwan and Los Angeles, USA resulting in containers overboard. The master had changed the ship’s passage plan to avoid severe weather caused by a developing depression east of Japan. The ship continued in heavy seas; rolling and pitching heavily with frequent bow flare slamming. Once the weather had abated, the crew discovered that the container stacks on the aft most bay had collapsed and toppled to port. Of the 151 containers in the stow, 42 containers overboard and 34 were damaged. Superficial damage was caused to the ship. Corrosion has emerged as the arch-enemy of the exhaust gas cleaning systems as the uptake of the technology rose with the entrance into force of the IMO 2020 sulphur cap.

Like with any new technology, scrubber maintenance and operation has been a learning curve for ship owners and operators, especially in the context of preventing failures of the technology and reducing downtime.

“Corrosion mainly happens on the overboard pipes, the last piece from GRE piping and connection to shell plating of the hull, especially near the connections and welding seams, and the area on the external hull around the overboard pipe outlet,” said Manuel Hof, Sales & Production Executive, NACE Coating Inspector Level 2 at Subsea Industries.

It seems appropriate to put the IIMS weight behind an awareness campaign of this kind, not least as one of the major roles of any marine surveyor, not just in the UK, is to help to keep lives safe at sea and to help protect vessels, cargoes and maritime assets.

Can UK waterways business be saved?

Canal river boats“The patient is being left to die.” Those were the stark words used by Paul Rodgers to describe how grave he sees the situation that UK waterways holiday hire companies, boatyards, boatbuilders, training operations, marinas, boat clubs and other waterways businesses find themselves in thanks to the collapse in business following the COVID-19 related shutdown.

There are now fears among UK waterways bodies of the demise of much of the sector as a result of the loss of this summer’s business – unless an immediate rescue package is put together.

IIMS advocacy acknowledged by Australian Senate as Performance of the Australian Maritime Safety Authority report is published

The International Institute of Marine Surveying’s (IIMS) submission to the Australian Senate, raising members concerns as to the direction and delivery of AMSA’s services for domestic commercial vessels, has been widely agreed with and extensively quoted in the Rural and Regional Affairs committee’s recently published report entitled Performance of the Australian Maritime Safety Authority.

IIMS expressed concerns over the new system’s excessive red tape, inappropriate and unsafe survey standards being applied and a lack of government concentration on safety management system development and implementation. These and other matters were highlighted by the IIMS and other submissions to the Australian Senate Committee.

The committee made four recommendations with the first three relating to legislative changes to better allow authorities to prosecute breaches of the law. The Cruising Association’s Regulations and Technical Services group (RATS) has been in communication with HMRC and confirmed, as a result of the March Budget Statement, that it is their intention to legislate that red diesel in the United Kingdom can only be used in agricultural equipment, on the railways and for non-commercial heating from 1st April 2022.

Since the propulsion of waterborne craft does not fit into these categories, it is HMRC’s intention that they will have to use white diesel for this purpose. The duty on white diesel for boats will be the same as the full rate paid on white road diesel in the UK. This means that the present so called ’60/40′ fuel duty split will disappear but commercial vessels, such as fishing boats, will still be able to claim a rebate on the full rate through their ‘Marine Voyages Relief’ scheme.
