Unit 31. Maritime Law & Insurance

As a professional surveyor one cannot get away from the reality that what you do in your everyday work may have legal implications, whether it be as an expert witness, a claim made by you for unpaid fees or indeed one made against you which might lead to your involvement in legal claims.

This unit aims to provide a broad understanding of English and international law, including international conventions, in the particular areas that you may come across in the maritime business that you are engaged in. This manual is by its nature a general introduction to law, international conventions, the carriage of goods by sea, marine regulations and marine insurance as it may affect you in your professional life and is no substitute for seeking proper professional advice where appropriate to do so. We look at the general principles of marine law and regulation and, to assist understanding, practical maritime based examples are used.

We look at the basics of the law of contract and tort and how these legal concepts may impinge upon the duties of the maritime surveyor. We also discuss the potential liability for a breach of these areas of civil law and responsibilities for employers.

We also consider marine insurance and in particular the insurance policy. We discuss the different types of insurance cover required on a vessel and some of the clauses in a typical policy for a yacht or commercial vessel. We shall look at the commercial charter market for commercial ships and some of the organisations involved in this market. This area is more by way of background given some surveyors will be instructed by insurance companies in claims’ scenarios.
